5. INDEMNIFICATION
You agree to indemnify, defend and hold harmless 3 Dimensional Wealth, its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the site from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by you.
The provisions of these Terms of Use are for the benefit of 3 Dimensional Wealth and its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the site. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.
6. TERMINATION
You understand and agree that 3 Dimensional Wealth may, in its sole discretion and at any time, terminate your username and password for any account created on the site. You understand and agree that 3 Dimensional Wealth may take this action without prior notice to you. Should 3 Dimensional Wealth take this action, it may, in its sole discretion, immediately deactivate and/or delete any or all information about and concerning your account, including information submitted for registration on the site and submitted content. 8. MISCELLANEOUS
These terms of use shall be governed by and construed in accordance with the laws of the State of Utah and the United States of America, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in Salt Lake City, Utah, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of any action relating to or arising out of your use of the site or this Agreement. You understand that by agreeing to the Terms, you and 3 Dimensional Wealth are each waiving the right to trial by jury or to participate in a class action. In no event shall you be entitled to injunctive or other equitable relief. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
9. SHIPPING AND RETURNS
a. This Section 9 applies to 3 Dimensional Wealth Products that are physical goods. For clarity, this Section 9 applies despite any contrary terms in any invoice or purchase order.
b. Orders are shipped using carriers selected by 3 Dimensional Wealth. The shipping fees you will be charged, if any, will be provided to you before you confirm your order. If we provide you with an estimated shipping date, the estimated delivery date is not guaranteed, and inventory shortages or events beyond our control could impact the delivery date. 3 Dimensional Wealth is not liable for delivery later than the estimated delivery date, or for any loss, damage, or penalty you may incur from a delay in shipment or delivery.
c. Unless otherwise noted in the product description or staff instructions, 3 Dimensional Wealth Products may be returned in their original packaging and condition within 30 days of purchase. However, unless we tell you otherwise, you will only be entitled to a refund if we provide you with an item that does not match the product description of the item that you purchased. If that occurs, your exclusive remedy is to return the item in unused condition, in exchange for a refund. To begin the return process, please email [email protected]. Return shipping instructions will be provided. 3 Dimensional Wealth will not cover the cost of return shipping and will refund your purchase price in full.
